AppControl Terms of Service and Software Licensing Agreement

This agreement outlines the terms for using the AppControl software and web services provided by this installer.

By clicking “I Agree”, you are giving your consent to abide by the terms mentioned below. By installing, running, or continuing to use AppControl after an update, you also accept the current version of this agreement. Only by accepting these terms can you use the AppControl software and related web services. If you don’t agree with any of these conditions close the installer, or uninstall AppControl in Windows add/remove programs. Please note that AppControl, owned by AppControl Labs LLC (a Texas USA LLC), does not grant you the right to use their software or related web services if you do not consent to the terms of this agreement.

By using the AppControl software, services, or website, you agree to the following terms and conditions:

Entire Agreement

This EULA represents the complete agreement between you and AppControl concerning its subject matter and supersedes all prior agreements and representations between the parties. This Agreement excludes the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Changes to the EULA

AppControl may update this EULA from time to time, along with its privacy policy, and we will give notice on its website with the date it was updated. Your continued use of the Software after an update constitutes acceptance of the updated terms.

Warranty

This software is provided ‘as-is’, without any express or implied warranty. This includes but is not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event will the authors be held liable for any damages arising from the use of this software. AppControl does not guarantee that the software will be free from bugs, errors, or other program limitations.

Critical Risk Environment or Industry

AppControl is not designed for use in critical risk environments or industries. Because the software gives you the ability to kill processes and disable publishers, it works best on everyday PCs where that level of control is appropriate. In settings where system uptime or safety is essential, this kind of tool is generally not recommended, in the same way you might avoid allowing access to the Windows Task Manager on a highly controlled or specialized computer system. If you work in a critical environment or industry, please review your internal policies and consider whether any tool that can stop critical processes should be enabled at all. If you choose to use AppControl in a critical environment or industry despite this guidance, you do so at your own risk and AppControl cannot accept responsibility for any outcomes. AppControl does not represent or warrant compliance with any safety, security, or regulatory standards required for such environments.

AppControl Disable/Kill Feature Warning

AppControl includes a simple rule system that lets you disable or kill processes on your Windows PC. Most people use this safely, but please take a moment to use good judgment when creating rules. Some publishers and processes are important for everyday PC functions. This can include tools that handle remote access or parts of Windows that help the system start. If your only way to reach a PC is through a remote connection and you disable a process that supports that connection, you may lose access to the PC until someone can reach it locally. If a critical process is disabled and you cannot re-enable it from the AppControl Apps screen, you can restart your PC in Windows Safe Mode. From there you can uninstall AppControl from Add or Remove Programs and then restart normally. AppControl has already whitelisted many core Microsoft processes so they cannot be disabled easily. However, Windows updates could potentially add new items that AppControl has not seen yet. Because of this, it is up to each user to apply disable or kill rules with the same care they would use when ending tasks in Windows Task Manager. You acknowledge that you alone are responsible for the rules you create, and AppControl has no duty to review, prevent, or warn you about rules that may impair system functionality.

App Insights Reliability Warning

AppControl may display insights about executables to help explain what they are and what they typically do. These insights may be incomplete, outdated, or inaccurate, and some files may have no insights at all. Do not treat insights as a guarantee of safety or purpose. If you choose to disable, kill, remove, or otherwise act on software because of an insight, you do so at your own risk. You are responsible for verifying any information shown, and you can report possible mistakes using the flag icon. AppControl is not liable for any damage, loss, or issues resulting from actions taken based on insights.

License Grant

We give you a non-exclusive, non-transferable revocable right to use the Software, defined by your license type and its activation count.

Ownership

AppControl retains all proprietary rights to the software. Any rights not explicitly granted to you remain with AppControl. AppControl retains exclusive ownership of all worldwide copyrights, trademarks, service marks, trade secrets, patent rights, moral rights, property rights and all other industrial rights in the Software and documentation, including any derivative works, modification, updates, or enhancements. All rights in and to the Software not expressly granted to User in this Agreement are reserved by Licensor. Nothing in this Agreement shall be deemed to grant, by implication, estoppel or otherwise, a license under any of Licensor’s existing or future patents. You agree to follow all proprietary laws that apply to your use of the AppControl software. The AppControl license gives you no rights, titles or any interests in any intellectual property owned by the licensor, and this license creates no relationship between the licensor and you other than that of licensor and licensee. Rights which are not granted to you through this license are automatically reserved by the licensor. You are not allowed to use AppControl without the licensor’s approval. AppControl may use certain software (open source or otherwise) developed by third parties. This software allows AppControl to do certain functions. All rights held by this third party software are reserved by the owner of the third party software and the owner of the third party software could enforce their rights against you directly in their own name. For example, open source licenses often have their own requirements to use their software. We will always list all open source software we use, if any.

Updates and Maintenance

AppControl reserves the right to release updates or modifications to the Software. You may be required to update the Software for continued use, and AppControl does not guarantee that updates will retain current Software features, free or otherwise. AppControl also reserves the right to change its licensing and other policies in the future. Some updates may modify, disable, or discontinue features, and by using the Software you agree that AppControl is not obligated to maintain any particular feature set.

Reverse Engineering

You may not reverse engineer, decompile, or disassemble the Software, for malicious purposes. AppControl may operate a bug bounty program for information security professionals because we as an organization want to support security professionals and their important work. We just ask that you not engage in the activities above in order to participate in piracy (cracks, etc…) or harm AppControl or its users. You may not cause problems that make our software unable to work for AppControl users, and you may not disrupt our servers or web services.

Technical Support

While AppControl doesn’t provide direct in-person or phone technical support for this Software, users can seek assistance through the AppControl forum or AppControl email helpdesk.

Data Backup

You are responsible for regularly backing up your PC or AppControl data. AppControl is not responsible for any loss of data that may occur due to any Software use or malfunction. You are solely responsible for ensuring compliance with any data privacy or retention requirements applicable to your environment.

AppControl may provide, or third parties may provide, links to other websites or resources. You acknowledge and agree that AppControl is not responsible for the availability of such external sites or resources.

Assignment

You may not assign your rights or obligations under this Agreement to another party without the express written consent of AppControl. AppControl may assign this Agreement to an affiliate, successor, or purchaser of the company or its assets.

Force Majeure

AppControl shall not be liable for any delay or failure in performance due to events outside the defaulting party’s reasonable control, including Software or Internet outages, Internet worms, Operating System bugs, war, fire, terrorism, natural disasters, plagues, or labor disputes.

System Requirements

The Software is designed to function on Microsoft Windows 10 and newer. While it might work on earlier Windows OS versions, AppControl does not guarantee compatibility or support.

Authentication

If the Software, code activation system, or the AppControl forum requires user authentication, you are responsible for all activities that occur under your account. You are responsible for safeguarding your password and should never disclose it to any third party. AppControl reserves the right to terminate forum accounts for any misuse (spam, harassment, copyright violations, or any illegal activities) or if any breach of security is suspected. AppControl may suspend or remove accounts at its sole discretion.

License Duration

This Agreement remains valid until one party ends it. To terminate from your side, stop using the AppControl Software and uninstall it completely where it’s no longer present on your system. AppControl can terminate the Agreement, especially if you breach terms or when updates are required. You can go to our AppControl home page and scroll to the bottom of the page for uninstall instructions. You should be able to go to add or remove programs in Windows to uninstall our software any time, but if you run into technical problems our uninstall page has alternate solutions.

Export Controls

Do not send or use the Software in countries sanctioned by the United States of America or the state of Texas. AppControl is not allowed in embargoed countries as listed by the US government. Abide by all international trade regulations. You agree to comply with all US export control laws, including the Export Administration Regulations (EAR) and OFAC regulations.

License Transfer

You’re prohibited from transferring or selling your Software license without written permission of AppControl.

Relationship and Ownership of Parties

All of AppControl’s intellectual property, including but not limited to trademarks, copyrights, and patents, remains its exclusive property. Third-party Software within AppControl retains its rights. AppControl also has the right to injunctive relief in addition to any other remedies available, especially if intellectual property ownership is violated.

Payments and Fees

AppControl can charge for its Software and services. You are responsible for infrastructure costs.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AppControl, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, that result from the use of, or inability to use, this Software. Under no circumstances will AppControl be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Software or the information contained therein. To the maximum extent permitted by applicable law, AppControl assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of the Software; (iii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iv) any interruption or cessation of transmission to or from the Software; (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Software by any third party; and/or (vi) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Software. In no event shall AppControl, its affiliates, agents, directors, employees, suppliers, or licensors be liable to you for any claims, proceedings, liabilities, obligations, damages, losses or costs in an amount exceeding the amount you paid to AppControl for the Software herein. This section shall survive the termination or expiration of this Agreement.

Governing Law

This Agreement is governed by Texas law, specifically Travis County. You consent to jurisdiction in Travis County, Texas. You also agree that any claim must be brought on an individual basis and within one year of the event giving rise to the claim, or it is permanently barred to the fullest extent permitted by law.

Arbitration

Any dispute arising from this Agreement or your use of the Software will be resolved through binding arbitration administered in Travis County, Texas. You waive any right to participate in a class action or class-wide claims. The arbitrator’s decision will be final, and judgment may be entered in any court with jurisdiction. Each party will bear its own costs unless the arbitrator rules otherwise. The arbitrator shall have no authority to award damages inconsistent with the limitations set forth in this Agreement.

No Waiver

AppControl’s non-action regarding Agreement rights doesn’t imply their forfeiture. Any waiver must be in writing and signed by AppControl to be effective.

Severability

If any clause is deemed unenforceable, the remainder of the Agreement stays in effect. Any unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original.

Termination

Agreement breaches can result in immediate termination of this license by AppControl. Upon termination, you must stop using and uninstall the Software, and AppControl may revoke access to any related services without notice.

Any breach of laws as reported by a court or law enforcement agency could lead to immediate Software and Agreement suspension by AppControl. You agree to indemnify and hold harmless AppControl for any claims or liabilities arising from your violation of applicable laws while using the Software.

Refund Policy

If any customer payment is made to AppControl, AppControl offers a 30 day money back guarantee that can be requested via our contact web page. Refunds apply only to purchases made directly from AppControl.

Uninstall

You can uninstall AppControl easily. Go to Windows Add/Remove programs, then find AppControl, then uninstall it. If you continue using the Software after attempting to uninstall, the Agreement remains in effect until the Software is fully removed.

By using AppControl, you consent to these terms.
